How to Resign in Italy: The Online Procedure Explained (2026)

Resigning from a job in Italy happens online. Learn the steps with SPID or CIE, notice periods, the 7-day withdrawal right, just cause and NASpI.

If you work for a private employer in Italy, you resign online. Handing in a letter or emailing your manager does not end your contract on its own. The law requires an online form from the Ministry of Labour, and a resignation made any other way has no effect.

The form itself takes a few minutes. Before you send it, check three things: your notice period, the date you enter, and the type of resignation. Foreign workers often miss this rule because it is so different from the US or UK, where a letter is enough.

The short version. The online procedure has been mandatory since 12 March 2016. You log in with SPID or CIE, or use an authorised intermediary such as a patronato. You have 7 days to withdraw. A voluntary resignation normally does not qualify for NASpI unemployment benefit, but a resignation for just cause does.

Who has to use the online procedure

The rule comes from article 26 of Legislative Decree 151/2015. The Ministry says its purpose is to stop "blank resignations", where a worker signs an undated letter when hired and the employer uses it later.

These cases are outside the procedure:

Most guides say the procedure is not needed during a probation period, but the Ministry pages we read do not cover it. Confirm with your HR office or a patronato.

Before you start: notice and the right date

Your notice period is set by your national collective agreement (CCNL) and your individual contract. It usually depends on your level and length of service. If you skip it, you owe your employer a payment in place of notice, which is normally deducted from your final pay.

The form asks for an effective date. This is normally the day after your last working day, and it must allow for your full notice. Work it out in writing first, because correcting a wrong date gets harder once the 7 days have passed.

How to resign online, step by step

1. Log in with SPID or CIE

Go to the Ministry of Labour portal and sign in with your digital identity. The Ministry names SPID and CIE. Some guides also list CNS, but the official pages we read do not mention it.

2. Check your employment details

For jobs that began after 2008, the system retrieves your details automatically. For older jobs, you enter the start date, the contract type and your employer's details, including an email or PEC address.

3. Fill in the form

Choose voluntary resignation or resignation for just cause, then enter the effective date. Read it carefully before you confirm, because the type you choose affects NASpI.

4. Send it and keep the receipt

Each saved form shows a transmission date and an identifier. Download a copy. It proves what you sent and when your 7 days began.

If you have no SPID or CIE

An authorised intermediary can file for you: a patronato, trade union, bilateral body, certification commission, labour consultant or local Labour Inspectorate office. Many patronati help foreign workers, so this is often the easiest route if your Italian is limited.

Changing your mind: the 7-day withdrawal

You can withdraw within seven days of sending the form, using the same online procedure. After that you can file a new resignation for the same job, but it cannot be withdrawn.

Just cause and NASpI

A voluntary resignation normally does not qualify for NASpI. Resigning for just cause is the exception, and it needs no notice. Just cause means someone else's behaviour makes it impossible to continue. INPS gives examples such as unpaid wages, sexual harassment, demotion, workplace bullying, and a transfer without proven business reasons.

Resigning during the protected maternity period also gives access to NASpI. That period runs from 300 days before the expected birth until the child's first birthday, and it excludes domestic workers. If you think you have just cause, talk to a patronato or union before you file, because you will need to be able to prove it.

Simply not turning up is not a shortcut. Since 12 January 2025, after at least 15 days of unjustified absence, or a longer period set by the CCNL, your employer can notify the Labour Inspectorate and your contract is treated as ended by you. You then have no right to NASpI. Courts do not all apply this rule the same way, so do not rely on it.

Do you still need a resignation letter?

Legally, no. The online form is what counts. A short letter is still a good courtesy, because it confirms your last day and your handover. Tell your manager in person first, so they do not learn about it from a notification.

FAQ

Is a resignation by email or letter valid in Italy?

For jobs covered by the procedure, no. Article 26 of Legislative Decree 151/2015 requires the online form, otherwise the resignation has no effect.

How much notice do I have to give in Italy?

It depends on your CCNL, level and length of service. If you skip it, a payment in place of notice can be deducted from your final pay. Resigning for just cause needs no notice.

Can I withdraw my resignation?

Yes, within 7 days of sending the form, using the same procedure. A new resignation filed after that cannot be withdrawn.

Do I get NASpI if I resign?

Normally no. The exceptions are resignation for just cause and resignation during the protected maternity period, provided you meet the other requirements.

What if I do not have SPID?

You can use CIE, or ask an authorised intermediary such as a patronato, trade union, labour consultant or local Labour Inspectorate office.
